LEGS 106 - Tort Law

Tort Law concerns the law of non-criminal injuries to persons or property. This course also addresses policy considerations that affect Tort Law. Topics include negligence, strict liability, product liability, intentional torts, affirmative defenses, and pre-trial investigation techniques and resources.

MAJOR COURSE LEARNING OBJECTIVES: Upon successful completion of this course the student will be expected to:

  1. Explain the elements, defenses and recoverable damages of negligence, as defined by Indiana Law.
  2. Identify the elements and defenses of each strict liability tort. Explain how strict liability differentiates from negligence and intentional torts.
  3. Describe the legal theories under which a product liability case can be brought in Indiana.
  4. Identify the elements and defenses of various intentional torts under Indiana Law.
  5. Explain how intentional torts differentiates from a negligence and strict liability cause of action.
  6. Explain how a paralegal would conduct a pretrial investigation, as well as the possible sources of relevant evidence.
  7. Describe a medical malpractice case and explain the process of filing one in Indiana.
  8. Identify the various policy considerations that affect tort law.
  9. Identify relevant ethical rules that relate to Tort Law.
