Tort Law concerns the law of non-criminal injuries to persons or property. This course also addresses policy considerations that affect Tort Law. Topics include negligence, strict liability, product liability, intentional torts, affirmative defenses, and pre-trial investigation techniques and resources.
MAJOR COURSE LEARNING OBJECTIVES: Upon successful completion of this course the student will be expected to:
- Explain the elements, defenses and recoverable damages of negligence, as defined by Indiana Law.
- Identify the elements and defenses of each strict liability tort. Explain how strict liability differentiates from negligence and intentional torts.
- Describe the legal theories under which a product liability case can be brought in Indiana.
- Identify the elements and defenses of various intentional torts under Indiana Law.
- Explain how intentional torts differentiates from a negligence and strict liability cause of action.
- Explain how a paralegal would conduct a pretrial investigation, as well as the possible sources of relevant evidence.
- Describe a medical malpractice case and explain the process of filing one in Indiana.
- Identify the various policy considerations that affect tort law.
- Identify relevant ethical rules that relate to Tort Law.
