LEGS 170 - Legal Ethics

Legal Ethics examines rules of professional conduct that apply to all legal professions including: the American Bar Association Model Rules of Professional Conduct, the Indiana Rules of Professional Conduct, the American Bar Association Guidelines for the Utilization of Legal Assistants; and various other sets of rules of conduct created by paralegal associations.

MAJOR COURSE LEARNING OBJECTIVES: Upon successful completion of this course the student will be expected to:

  1. Describe how attorneys are licensed and regulated.
  2. Describe the role that the American Bar Association plays in the regulation of lawyers and paralegals.
  3. Describe the role that national paralegal associations play in the promotion of professional rules of conduct for paralegals.
  4. Distinguish between paralegal licensure and paralegal certification.
  5. Demonstrate an understanding of the application of the primary rules of lawyer conduct that affect the performance of paralegals.
  6. Distinguish between authorized tasks that paralegals can perform and the unauthorized practice of law.
  7. Distinguish between the ethics doctrine of lawyer-client confidentiality and the discovery doctrines of attorney client privilege and the work product rule.
  8. Demonstrate an understanding of the common conflicts of interest that are likely to arise in the law office.
  9. Distinguish between the imputed disqualification rules that apply to lawyers and imputed disqualification rules that apply to paralegals.
  10. Distinguish advertising from solicitation and demonstrate an awareness of how a paralegal’s conduct is proscribed by the advertising and solicitation rules.
  11. Distinguish the types of legal fees, and what makes a legal fee unreasonable.
  12. Demonstrate an understanding of the rules that regulate fee sharing between lawyers and paralegals.
  13. Demonstrate an understanding of the ethics rules that concern honesty in litigation.
