LEGS 202 - Litigation


PREREQUISITES: LEGS 101 - Introduction to Legal Studies  and LEGS 103 - Civil Procedure

The study of Indiana trial rules pertaining to actual trial. Topics include the discovery process and discovery tools, litigation support-including organization and retrieval of trial documents-techniques in preparing witnesses for trial, and preparing jury instructions. The main project is compiling a trial notebook.

MAJOR COURSE LEARNING OBJECTIVES: Upon successful completion of this course the student will be expected to:

  1. Compare and contrast various Indiana Trial Rules with various Indiana Rules of Civil procedure.
  2. Compare and contrast various Federal Trial Rules with various Federal Rules of Civil Procedure.
  3. Prepare a trial notebook that includes the ability to draft and explain the following:
    1. Intake Client Information Sheet
    2. Checklist and Intake Memorandum
    3. Internal Memorandum
    4. Complaint
    5. Answer
    6. Counterclaim
    7. Discovery
    8. Deposition Summary
    9. Motion of Summary Judgment
    10. Exhibit Summary List
    11. Trial Brief
    12. Jury Instruction
    13. Notice of Appeal
  4. Schedule an index deposition.
  5. Summarize the purpose of calendaring.
  6. Explain the time limitation for the filing of and/or responding to various pleadings, motions and requests.
  7. Explain and justify the order of presentation of various witnesses
  8. Explain and justify the order of presentation of various trial exhibits
  9. Critiqued various types of technology available to assist with the litigation process
