An introduction to the Indiana law of marriage, dissolution, custody (including UCCJA), visitation, support (including URESA), adoption, and guardianship of minors. Students will review many pleadings and intake forms and will draft a divorce petition, a financial statement, a summary decree with a child support worksheet.
MAJOR COURSE LEARNING OBJECTIVES: Upon successful completion of this course the student will be expected to:
- Describe the requirements for marriage and the basic law regarding dissolution, separation, child custody and support, paternity, adoption, and contempt actions under Indiana law.
- Complete various forms and prepare rough drafts of petitions, motions, and decrees including, but not limited to:
- Petition for Dissolution
- Petition for Modification of Support
- Petition to Establish Paternity
- Identify the major objectives of an initial client interview.
- Compute child support and spousal maintenance pursuant to state law.
- Identify available social service agencies and other resources used to assist families with custody, parenting, and combating family violence.
- Describe the history, purpose and proper statutory formation of premarital agreements.
- List factors the courts consider when dividing property and liabilities upon divorce.
- Describe the role the courts play in approving, modifying, and enforcing separation agreements.
- Describe and apply the Indiana Parenting Time Guidelines to child custody and visitation decisions.
