LEGS 228 - Wrongful Conviction

The Wrongful Conviction course will be a service learning opportunity, designed specifically for our evening students who are not be able to participate in our daytime practicum program. In this course, students will explore the three major areas giving rise to claims of wrongful conviction by reviewing case, constitutional and statutory law. In addition, students will be given issues to investigate related to an active case.

MAJOR COURSE LEARNING OBJECTIVES: Upon successful completion of this course the student will be expected to:

  1. Discuss, interpret and examine case, constitutional and statutory law related to ineffective assistance of counsel claims.
  2. Discuss, interpret and examine case, constitutional and statutory law related to prosecutorial misconduct.
  3. Discuss, interpret and examine case, constitutional and statutory law related to discovery of new evidence.
  4. Apply understanding of ineffective assistance of counsel, prosecutorial misconduct, and discovery of new evidence to a client’s claim.
  5. Evaluate client’s claim for appropriate appellate arguments.
  6. Examine the process of the criminal appellate system, including post-conviction relief.
  7. Discuss and model the confidentiality required within a law office.
  8. Investigate issues in a client’s case.
  9. Create a legal theory about a client’s case based on the investigation.
  10. Create a legal work product defending the legal theory of the client’s case under the supervision of an attorney.
  11. Develop and present a group project relevant to the client’s factual situation.
