MORT 102 - Mortuary Law in Management

Implementation of best practices, complete understanding and implementation of legal principles is essential for effective management. Principles of mortuary law in the managerial role including; duties, rights and liabilities for final disposition will be evaluated. Business law; public and personal liability; business organization; licensing and zoning regulations from a management perspective is also evaluated. Probate proceedings, social security, and life insurance benefits, and ethical standards relating to funeral service will be described.

MAJOR COURSE LEARNING OBJECTIVES: Upon successful completion of this course the student will be expected to:

  1. Analyze and interpret federal, state, and local regulations pertaining to the funeral profession from a manager’s perspective.
  2. Summarize a management plan that meets the Occupational Safety and Health Administration Regulations.
  3. Analyze and interpret the Uniform Anatomical Gift Act.
  4. Describe a plan to meet the Federal Trade Commission requirements.
  5. Analyze and interpret and discuss the Rules and Regulations for the Control of Communicable Disease.
  6. Analyze, interpret and explain compliance methods associated with any other regulations governing funeral service.
  7. Analyze and interpret and comply with statutory laws and practices pertaining to funeral service management.
  8. Analyze, interpret and enforce management strategies associated with the laws that govern the funeral director and embalmer and their legal responsibilities to the consumer.
  9. Analyze, interpret and compliance with building and zoning ordinances relating to the funeral establishment will be discussed.
  10. Analyze and interpret tort liability, cemetery laws, wills, and the administration of estates.
  11. Analyze and interpret ethical considerations related to the funeral service profession.
  12. Identify the various documents which are required to be prepared in funeral service.
  13. Explain the content of effective employee training programs to meet federal and state regulations.
  14. Discuss policies that ensure a funeral home maintains legal compliance.
