HSPS 218 - Legal Considerations for Homeland Security/Public Safety


PREREQUISITES: Demonstrated competency through appropriate assessment or earning a grade of “C” or better in ENGL 083 - Reading Strategies for College  and ENGL 093 - Introduction to College Writing , or ENGL 095 - Integrated Reading and Writing , or ENGL 075 - Co-Requisite Integrated Reading & Writing

Provides a general introduction into legal considerations in the fire service. Students can use it as a guide to the legal issues associated with the fire service. Technical areas to be covered will be understanding legal issues that are intertwined with the fire service, legal liability, sovereign immunity, overtime laws, collective bargaining, OSHA compliance, worker’s compensation, physical abilities testing, medical examinations, drug testing, discrimination, and sexual harassment.

MAJOR COURSE LEARNING OBJECTIVES: Upon successful completion of this course the student will be expected to:

  1. Explain the types and sources of laws.
  2. Identify and review the court and court systems.
  3. List and compare the types of fire departments.
  4. Examine and discuss administrative agencies.
  5. Define criminal law and compare to civil law.
  6. Examine criminal procedure
  7. Analyze civil liability issues including negligence and immunity from liability.
  8. Apply labor law and collective bargaining.
  9. Assess contract law and employment issues.
  10. Discuss employee rights and discrimination.
  11. Explain sexual harassment and other forms of employment discrimination.
  12. Review fair labor, family medical leave, residency, and drug testing.
  13. Explain public accountability law.
